In June 2024, Governor Phil Murphy signed new legislation into law!

Effective September 2024, many changes were made, including:

• voting records
• restraining orders for harassment
• anonymous GRC/court claims may be dismissed
• custodians responses presumed to be reasonable
• custodian liability shifts to agency
• 2026 – GRC complaints adjudicated 90 days – 120 days
• fee shifting NOT automatic
• updated OPRA forms
• reasonable extension codified in statute
• anonymous requestors – burden shift
• stored records – 21 days response
• Simmons v. Mercado – record transferred to another agency
• public posting on website – appeal process
• ..and much more

Municipal clerks: approved for 6 CEUs
